Commercial DUI Rules & Penalties
California law states that anyone who has a blood alcohol concentration (BAC) level over 0.08% is legally intoxicated and must not operate a motor vehicle of any kind. Commercial drivers are held to much stricter standards, reaching legal intoxication at only 0.04%. Law enforcement officers are also permitted to determine dangerous intoxication on their own, meaning you could be arrested for commercial DUI even if your BAC is below the legal limit.
If convicted of a commercial DUI, you could face:
- Jail time
- High fines
- Ignition interlock device installment
- Automatic license revocation
You will be unable to operate your vehicle in accordance to your occupation, creating the risk of unemployment. Unlike a standard DUI, commercial DUI convictions also usually require drivers to retake driver’s education courses and pay high reinstatement fees to regain their driving privileges. Additionally, commercial drivers must be aware that receiving a DUI in their personal vehicle can cause them to lose the right to operate their commercial vehicle as well.
Occupations that could be affected by a commercial or standard DUI include:
- Commercial truck driver
- Bus driver
- Mail courier
- Food delivery service driver
