San Diego Lewd Conduct Defense Attorney
Charged with Engaging in or Soliciting Lewd Conduct?
What Constitutes as "Lewd Conduct" Under California Law?
According to California Penal Code 647(a), you could be arrested for lewd conduct if you engage in certain inappropriate acts while in a public place. For example, exposing your "private parts" while in public for the purpose of sexual gratification could lead to a lewd and lascivious conduct charge. Not only could this lead to thousands of dollars in fines and a state prison or county jail sentence, but you may even be required to register as a sex offender in the state of California.
For this reason, it is imperative that you move quickly to retain the help of a San Diego criminal defense lawyer from JD Law as soon as you have been arrested.
The Penalties for Lewd & Dissolute Conduct
If you have been accused of violating Penal Code 647(a), you could face a misdemeanor charge that is punishable by 6 months in jail and/or a fine of $1,000. While it is currently not required that you register as a sex offender if you are convicted of this offense, the prosecutor may choose to tack on a charge of indecent exposure, which could lead to lifetime registration. Since most acts of lewd conduct involve the alleged offender exposing his or her genitals and/or engaging in otherwise sexual acts, this could be a likely scenario. Fortunately, our firm is experienced in handling such cases.
Depending on the circumstances of your arrest, we may be able to show that:
- You did not expose and/or touch your private parts.
- You did not touch your private parts for sexual gratification.
- You did not realize that another person was present.
- You were not in a public place when the act was committed.
- You were a victim of police entrapment.
