Penalties for a Second DUI Offense
The penalties for a second DUI offense can include the following:
- 3-5 years of probation
- Vehicle impoundment
- Fines and fees as high as $2,800
- 2 years of driver's license suspension
- Mandatory jail time of, minimum 90 days - up to 1 year
- Mandatory treatment program
Ignition interlock device installation
The penalties are increased at several levels of BAC. At 0.14%, 5 days
mandatory jail time. At 0.15% to 0.19%, 10 days are mandatory. At 0.20%
to 0.24%, 20 days are mandatory, and at 0.25% and above, 30 days are mandatory
to be served.
DUI Penalties for a Conviction with Priors
The penalties for these offenses can include:
- Mandatory jail or prison time (for felony offenses)
- Expensive fines and court fees
- Mandated treatment programs
- License suspension or revocation
- Added charges for probation violations
With 2 prior convictions, the DMV will be advised to revoke your license
for 3 years, and to consider a 10 year license revocation, as well as
expensive fines, jail time and other punishments. The fines will be minimally
$2,834, plus added costs, and there is a 3 month mandatory jail sentence.
The judge has no option to give you a lighter sentence under these updated laws.
