Charged with DUI While Stationed at Camp Pendleton?

Have you been charged with driving under the influence (DUI) while stationed at Marine Corps Base Camp Pendleton? If so, you could be facing numerous judicial and non-judicial punishments. DUI arrests for military service members can be particularly complex and can often bring consequences that are far more severe than a typical civilian DUI case, especially if the alleged offense occurs on the installation.

Military service members live in two worlds – one that is controlled by the military, and one that is controlled by civilian authorities. As such, the resulting prosecutorial process will vary depending on whether a service member was arrested on-installation or if they were arrested by local police.

Off-Base DUI Charges

Drunk driving charges that occur off-base will be prosecuted in civilian court and will in many ways be similar to any other DUI case. In such circumstances, you may face the following consequences if found guilty:

  • Expensive fines
  • Possible jail time
  • A lengthy driver’s license suspension or revocation
  • Community service
  • Vehicle confiscation
  • Possible mandatory alcohol treatment
  • Ignition interlock device installation

Exact penalties will vary depending on your history of prior offenses, whether or not you submitted to a chemical test, and any other aggravating factors surrounding your arrest. It is important to note that once you are charged in civilian court, the military will no longer be able to pursue prosecution for the same violation.

On-Base DUI Charges

If your arrest occurred on base, your case will be handled by military police and you will likely be prosecuted under the Uniformed Code of Military Justice (UCMJ) in a military court martial. Additionally, the military may pursue prosecution for charges not being pursued in civilian court. Unlike in civilian DUI cases, there is no maximum legal sentence for military DUI, meaning that the court has complete discretion in deciding a sentence. If convicted under UCMJ, you may face the following penalties:

  • Reprimand
  • Additional duties
  • Reduced pay
  • Demotion
  • Confinement
  • Dismissal
